Terms of Use
These Terms of Use govern your access to and use of Hypho, including the Hypho mobile app, lessons, quizzes, subscriptions, and related services. Hypho is operated by Tyler Ericcsen. If you have questions about these Terms, contact us at tyler.ericcsen@gmail.com.
By creating an account, accessing Hypho, purchasing a subscription, or using the app, you agree to these Terms. If you do not agree, do not use Hypho.
1. Who May Use Hypho
Hypho is not directed to children under 13 years old. You must be at least 13 years old to use Hypho.
If you are under the age of majority where you live, you may use Hypho only with permission from a parent or legal guardian. By using Hypho, you represent that you meet these requirements.
2. About Hypho
Hypho is an educational app designed to help users learn AI concepts through lessons, quizzes, streaks, progress features, and related learning tools.
Hypho is provided for educational and informational purposes only. We do not guarantee any specific learning result, professional outcome, job outcome, certification, income, or improvement in skill.
3. Accounts
You may need to create an account to use certain parts of Hypho. You are responsible for keeping your account information accurate and for maintaining the security of your account.
You are responsible for activity that occurs through your account. If you believe your account has been compromised, contact us at tyler.ericcsen@gmail.com.
We may suspend or terminate access to Hypho if we believe you have violated these Terms, misused the app, created risk for other users, or used Hypho unlawfully.
4. Hypho Max Subscription
Hypho may offer a paid subscription called Hypho Max. Hypho Max is currently offered for $19.99 per month. There is no free trial at this time.
Your subscription provides access to the paid features, content, or services described in the app at the time of purchase. Subscription features may change over time as Hypho develops, but we will not intentionally remove access to paid features during an active billing period without providing a reasonable replacement or adjustment.
5. Billing, Renewal, Cancellation, and Refunds
Hypho Max subscriptions purchased through the iOS app are billed by Apple through your Apple ID.
Subscriptions automatically renew each month unless canceled at least 24 hours before the end of the current billing period. Your Apple ID account will be charged for renewal according to Apple's billing rules.
You can manage or cancel your subscription through your Apple ID subscription settings. Deleting the Hypho app or deleting your Hypho account does not automatically cancel an Apple subscription.
Refund requests for purchases made through Apple are handled by Apple according to Apple's policies.
6. Restore Purchases
If you have an active Hypho Max subscription purchased through Apple, you may use the restore purchases option in the app to restore access on a device using the same Apple ID.
7. Privacy
Your use of Hypho is also governed by our Privacy Policy, available at:
https://www.hypho.ai/privacy-policy
The Privacy Policy explains what information we collect, how we use it, and how you can request deletion or exercise privacy choices.
8. Account Deletion
Hypho allows users to request or perform account deletion in the app. When you delete your account, we will delete or de-identify account information as required by applicable law and our Privacy Policy. Some limited information may be retained where necessary for legal, security, fraud prevention, billing, dispute resolution, or legitimate business record purposes.
Deleting your Hypho account does not automatically cancel an active Apple subscription. You must cancel subscriptions through your Apple ID subscription settings.
9. User Content
At this time, Hypho does not allow users to upload public content or create content for other users to view.
If Hypho adds user-generated content features in the future, these Terms may be updated to explain the rules for that content.
10. Acceptable Use
You agree not to:
- Use Hypho for unlawful, harmful, fraudulent, abusive, or deceptive purposes.
- Attempt to interfere with, damage, reverse engineer, decompile, scrape, copy, or disrupt Hypho or its systems.
- Attempt to gain unauthorized access to any account, system, data, or service.
- Use Hypho to infringe intellectual property, privacy, publicity, or other rights.
- Misrepresent your identity or create accounts using false or misleading information.
- Circumvent payment, subscription, access, or security features.
- Use Hypho in a way that could impair the app for other users.
11. Intellectual Property
Hypho, including its app design, lessons, quizzes, text, graphics, branding, software, features, and related content, is owned by Tyler Ericcsen or licensed to Hypho.
These Terms do not transfer ownership of Hypho or its content to you. You may use Hypho only for your personal, non-commercial learning purposes, subject to these Terms.
You may not copy, distribute, sell, modify, publicly display, or create derivative works from Hypho content unless we give you written permission.
12. Third-Party Services
Hypho may rely on third-party services for functions such as authentication, hosting, analytics, payments, app distribution, crash reporting, or data storage.
Your use of Hypho may also be subject to the terms and policies of those third-party services, including Apple's App Store terms.
13. Apple App Store Terms
If you download Hypho from the Apple App Store or purchase a subscription through Apple, your use of the app is also subject to Apple's applicable terms, including Apple's Standard Licensed Application End User License Agreement, available at:
https://www.apple.com/legal/internet-services/itunes/dev/stdeula/
Apple is not responsible for providing support or maintenance for Hypho except as required by applicable law.
14. No Personalized Professional Advice
Hypho is an educational product. Hypho does not provide legal, financial, medical, employment, academic, security, or professional advice.
Any AI-related concepts, examples, lessons, or explanations are provided for general education only. You are responsible for how you apply what you learn.
15. Changes to Hypho
Hypho is still evolving. We may add, remove, change, suspend, or discontinue features, lessons, subscriptions, content, or services at any time.
We will try to avoid changes that materially reduce the value of an active paid subscription during the current billing period.
16. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the Effective Date above.
If changes are material, we may provide additional notice in the app or by other reasonable means. Your continued use of Hypho after updated Terms become effective means you accept the updated Terms.
17. Disclaimer of Warranties
Hypho is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and reliability.
We do not guarantee that Hypho will be uninterrupted, error-free, secure, or free of harmful components.
18. Limitation of Liability
To the maximum extent permitted by law, Tyler Ericcsen and Hypho will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, loss of goodwill, or business interruption.
To the maximum extent permitted by law, our total liability for any claim related to Hypho or these Terms will not exceed the amount you paid to Hypho in the three months before the event giving rise to the claim, or $50, whichever is greater.
Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.
19. Indemnification
You agree to defend, indemnify, and hold harmless Tyler Ericcsen and Hypho from claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees, arising from your misuse of Hypho, violation of these Terms, violation of law, or violation of another person's rights.
20. Termination
You may stop using Hypho at any time. We may suspend or terminate your access to Hypho if you violate these Terms, create legal risk, misuse the service, or if we discontinue the app or relevant parts of it.
Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnification, governing law, and dispute-related terms.
21. Governing Law
These Terms are governed by the laws of the State of Washington, United States, without regard to conflict of law principles.
